Would You Bring It Back?

Today I want to share my view on a topic that is highly controversial. Probably I would not come up with the idea of writing a post about it, but since @galenkp listed it as a topic in his Weekend Engagement post, I thought I'd give it a try.

The topic I want to talk about today is if capital punishment is legit or not. Before I go into details, here's what capital punishment means in Europe, for those who are not familiar with how things stand these days.

Capital punishment has been completely abolished in all European countries except for Belarus and Russia, the latter of which has a moratorium and has not conducted an execution since September 1996. The complete ban on capital punishment is enshrined in both the Charter of Fundamental Rights of the European Union (EU) and two widely adopted protocols of the European Convention on Human Rights of the Council of Europe, and is thus considered a central value. Of all modern European countries, San Marino, Portugal, and the Netherlands were the first to abolish capital punishment, whereas only Belarus still practises capital punishment in some form or another. In 2012, Latvia became the last EU member state to abolish capital punishment in wartime. source

In my country, the last execution took place in 1989, when the ex dictator and his wife were put against the wall and executed. The law regarding capital punishment was abolished at the beginning of 1990, right after the regime change.

The maximum punishment you can get right now is life. That means you will be locked up till the end of your life, but there's a possibility to be released after serving 20 years, if you have a good behavior and meet certain conditions.

Now, to answer the question, do I want death penalty back? In some cases, yes, I do, it would be recommended as there are people who don't deserve a second, third, fourth and tenth chance, yet they still get it and become repeated offenders.

I don't blame those countries that still have the death penalty for serious offenses. Sometimes I see in the news that in the United States some people are given multiple life sentences. We all know we only have one life to live, so one can only serve one life sentence.

Why Give Multiple Life Sentences?

As you can see, certain life sentences don't always result in actual life imprisonment. But even where the sentence is life without the possibility of parole, consecutive (back-to-back) life sentences may serve a practical purpose. Most often, multiple life sentences arise in murder cases involving multiple victims.

To take a situation involving the possibility of parole, suppose that a defendant is on trial for two murders. The jury convicts him of both, and the judge sentences him to consecutive life sentences with the possibility of parole. State law allows the defendant to apply for parole after 20 years. By sentencing the defendant to consecutive life sentences, the judge has likely ensured that he will be behind bars for at least 40 years.

Now let's say the defendant received consecutive life sentences without the possibility of parole. Here, the defendant appeals the convictions and a court overturns one because the prosecution didn't comply with its discovery obligations. That takes one life sentence off the books—at least until the defendant can be retried. But the other life sentence remains in effect. source

Things are not as simple as one may think and each case is unique, so there's no pattern on how things are done.

It would be ideal if people would respect private or any property and each other as well, but no matter what you do, some people are just bad. Some people never learn, never change as they don't want to.

Back in the day when the justice system was nothing like it is now, you could hang based on some so called witness statements. Inflicting fear into people was the main purpose of public executions. Those times are long gone, every citizen is aware of what is allowed and what not (not being aware does not absolve you of responsibility), so people should act accordingly, but as I said earlier, some people are just bad.

I think some offenses deserve the death penalty and I also think any convicted person should have the option to euthanasia, in case they think they don't want to live the life they have to and if they see no hope to be released. But for that to happen, you need proper legislation and a fair justice system, without abuse.

And if we're at the topic, I also think some countries should ease up on their capital punishment legislation, regarding things that they consider offense, things that are legal in other countries.

One would expect countries to evolve in the right direction but the truth is, sometimes tings can go backwards as well. Instead of marching towards more freedom, restrictions are brought back. The US is restricting the right to abortion, so who knows what's next. It's possible capital punishment will be more common. Europe is a different discussion as EU member countries have to respect union laws as well, so I suppose Belarus and Russia are the only two countries doing what they want.

The issue of the death penalty is something that in my opinion should continue to be applied, especially to people who, no matter how many opportunities they are given, do not change, so they deserve it.

Today we live in a world surrounded by violence, too many mentally ill people, who take advantage of women and children, those are the ones who deserve it the most.

You're right, some people never learn and continue to do bad things knowingly. Those don't deserve another chance and death penalty maybe the only punishment.

Mentally ill people should be institutionalized and under treatment, but there's never enough money for them.

I kind of agree with you. Some people don't deserve to rot in prison. Instead of the death penalty though, I think they should be put to doing manual labor for life instead or something. I feel like giving them death would just be the easy way out for them. There has to be ways they can in a sense "suffer" without dying so they can actually reflect on what they've done wrong. I guess you could defend this by saying if we keep them alive we are also wasting precious resources on them such as shelter , food etc. It's hard to say what should be done but maybe in the future there will be more creative ways to punish criminals than just letting them rot for life in prison or giving the death penalty.

I didn't want to mention the cost of feeding someone for 40 or 50 years, but imagine those funds could be used for good projects.

As about putting prisoners to work, some are working, but the right to work has to be earned. Those heavy guys, very dangerous most likely are not allowed.

Ya exactly all the resources used on them! They get free food. I don't know there just has to be other ways than just working? I know that some do work but i don't know lol there has to be ways worse than death and legal. sadly they can't be tortured or anything.

It is most definitely needed as the world has become too soft, How many chances do people need and living in a dangerous country where people are killed for their phones etc the death penalty is required. I wish they would bring it back as it should be a deterrent.

In some countries, especially in those where people consider looting, stealing and killing for whatever they can get their hands on, it is a must, I agree.

I totally agree with you, some crimes deserve to have the death penalty, and in the case of the condemned person, I think it should be depending on the crime. In Venezuela there is no death penalty or life imprisonment, (and it seems to me that it was one of the first countries to prohibit it) the maximum time is 30 years.

I agree with you, life sentences and death sentences sometimes have to be given to convicts who have committed serious crimes, otherwise they will arbitrarily do anything that will violate the norms of human life such as rape and murder

I was always blaming my country that they still have death sentence but I got to realize that no matter how much you torture some people, they will not make any change

Good article with valid arguments. I agree with the death penalty for those who murder the innocent with no regard. The Bible permits for the death penalty and in the Old Testament God laid down very specific guidelines for applying it. There were also cities of refuge set up in every Tribe of Israel to protect the one who shed blood innocently to prevent vigilante justice from taking place. I am amazed that many want to protect a murder who has killed for no reason other than their own lust and greed. In the end, God will sort it out, but if society permits a known murderer to go free and that murderer goes out to murder again, those who set him/her free are guilty of innocent blood. These are just my thoughts as I observe the world as it decays unspeakably here in the United States.

That is a can of worms, who gives a judge the god gene? To take a human life,is he too not a killer? Then to keep a person in prison is a drain on funds that could be better spent.

Bring back the Victorian workhouse, meagre food portions, regular corporal punishment, none of this cushy easy jail time with tv’s and PlayStations.

In my opinion, capital punishment should be practiced, especially in cases of rape, murder and corruption.

But victims must be given fair trial in court and proven guilty beyond reasonable doubt before the sentencing.

Life is the most valuable thing on earth, people shouldn’t take such a gift for granted and there should be a way of punishing people who do not deserve the gift of life.

Some countries still have the death penalty, for example in my country. And there are some people who seem more satisfied when they receive the death penalty. Maybe they've gone through a prison time or two before. Death is easier for them than living in a place of oppression, mistreatment and constant abuse. They are not well protected and they don't want to come back again, especially life sentences.

Legitimate fairness, solid legal foundation in Vietnam is low and needs a lot of improvement.
