HiveP2P reafirma su naturaleza descentralizada [ES-EN]

A few days ago, @hivecuba.p2p was forced to halt its operations. Fortunately, our systems, designed from the start with on-chain security in mind, rely solely on the HIVE blockchain to operate safely and in a decentralized manner.

Short Horror Story: OFAC vs HiveP2P

It all started because our domain provider NameSheap, under U.S. jurisdiction, declared that the domains hivecuba.com and hive-p2p.com violated their terms of service. To recover the domains, the owners were required to go through a KYC verification process (impossible if you are Cuban and live in Cuba). NameSheap is a domain provider that initially only asks for an email to register, and only requests KYC in cases of violations (OFAC complaints). The hivecuba domain, and especially hive-p2p, as an independent, decentralized service for unregulated asset exchange with a country sanctioned by OFAC, fell victim to the fine print: NameSheap is registered with ICANN in the U.S., so it is bound by U.S. regulations and cannot process transactions (registration, renewal, transfer) with sanctioned persons/entities.

Upon investigating, there are other precedents, for example:

The case of Steve Marshall (2008):
A British citizen residing in Spain managed 80 websites related to travel to Cuba. His U.S. registrar (eNom) received a call from OFAC and blocked all domains, considering them "blocked property" under the Cuban sanctions. eNom refused to transfer the domains to another registrar, claiming that the transfer would also violate OFAC regulations.

Therefore, if you live in Cuba or your service has anything to do with Cuba, you must keep in mind that domain providers like Namecheap, Porkbun, GoDaddy, and any registrar that applies KYC with nationality verification may declare you in violation of their terms and conditions for being a national of a sanctioned country (Iran, Cuba, Syria, North Korea, Crimea), even if you reside outside those countries.

What's really curious is that this incident occurred right after HiveP2P was represented at the VIII Crypto Summit in Moscow, where there were intentions and efforts from Russian entities, clearly sanctioned by OFAC. We defend the right that crypto is for everyone.

There's no stopping you when you're decentralized

The domain block forced us to halt our services, as the web links were not working. We took on the task of researching and testing several alternatives. We lost the .com and switched to .net, but along the way we established strategies in case we ever face a similar situation again. From this experience we have learned several lessons. One of them is read the fine print and another is that cheap does not mean better.

From the definition of the initial architecture, all storage and operations are based on HIVE as a decentralized immutable database. This has shown us that even if our services are erased, as long as the HIVE blockchain remains functional, we can rise again like the Phoenix without any user's assets being affected—only the delay of our rebirth would impact them. That is the power of HIVE, which we will expand in our future developments.

A pause for self-reflection

We have delayed giving explanations because it is not advisable to stir up dust without a plan behind it. We have made sure to back up everything necessary, verify the security of all systems, and above all, look for new alternatives in case new malicious obstacles arise. The crypto space and the inherent freedom have enemies in all policies; escaping control is feared by those who exercise it.

We have slowed our pace, but so that each step is firmer. New opportunities and alliances are coming that will make HIVE and its ecosystem an access point for everyone to the global economy. We are already part of that change, and you too.

Hace unos pocos días @hivecuba.p2p tuvo que detener sus operaciones de manera forzosa, por suerte nuestros sistemas diseñados desde el inicio pensados en la seguridad onchain, solo dependen de la blockchain HIVE para operar con seguridad y descentralización.

Historia de Terror Corta: OFAC vs HiveP2P

Todo surgió porque el proveedor de dominio que teníamos NameSheap, con juridicción en EE.UU declaró que los dominios hivecuba.com y hive-p2p.com incumplen los términos del servicio, requiriendo para valorar recuperar los dominios un proceso de verificación KYC (Imposible si eres Cubano y además vives en Cuba). NameSheap es un proveedor de dominio que en principio solo solicita para el registro un correo y solo en casos de violaciones (denuncias de la OFAC) solicitan KYC. El dominio hivecuba y sobre todo hive-p2p al ser un servicio independiente, descentralizado para el intercambio no regulado de activos con un país sancionado por la OFAC estuvo marcado por la letra pequeña: NameSheap está registrado ante la ICANN de EE.EE. UU. por lo que está obligada a sus regulaciones y no puede procesar transacciones (registro, renovación, transferencia) con personas/entidades sancionadas.

Por tanto, si vives en Cuba o tu servicio tiene algo que ver con Cuba debes tener en cuenta que proveedores de dominio como Namecheap, Porkbun, GoDaddy, y cualquier registrador que aplique KYC con verificación de nacionalidad, te pueden declarar como incumplidor de sus términos y condiciones al ser nacional de país sancionado (Irán, Cuba, Siria, Corea del Norte, Crimea) aunque residas fuera de esos países.

Lo realmente curioso es que este incidente ocurriera justo después de que HiveP2P fuera representado en el VIII Crypto Summit de Moscú donde hubo intenciones y gestiones de entidades rusas, claramente sancionadas por la OFAC. Defendemos el derecho a que crypto es para todos.

No hay como detenerte cuando se está descentralizado

El bloqueo de dominio nos obligó a detener nuestros servicios, pues los enlaces web no funcionaban. Nos dimos a la tarea de investigar y probar varias alternativas. Perdimos el .com y pasamos a .net, pero en el camino establecimos estrategias por si alguna vez más tenemos un suceso parecido, de esta experiencia tenemos aprendidas varias lecciones. Una de ellas es leer la letra pequeña y la otra que barato no significa mejor.

Desde la definición de la arquitectura inicial todo el almacenamiento y operatividad está basada en HIVE como base de datos inmutable descentralizada, eso nos ha demostrado que pueden incluso borrar nuestros servicios que mientras la blockchain HIVE sigue funcional podremos revivir como el ave Fénix sin que ningún usuario vea afectado sus valores, solo la demora de nuestro renacer lo afectaría. Es el poder de HIVE que expandiremos en nuestros desarrollos futuros.

Una pausa de autoreflexión

Nos hemos demorado en dar razones pues no es conveniente levantar el polvo si no hay un plan detrás. Nos hemos asegurado de respaldar todo lo necesario, verificar la seguridad de todos los sistemas y sobre todo buscar nuevas alternativas por si aparecen nuevos tropiezos mal intencionados. El tema crypto y la libertad inherente tienen enemigos en todas las políticas, escapar del control es temido por los que lo ejercen.

Hemos disminuido el paso, pero para que cada uno sea más firme, se avecinan nuevas oportunidades y alianzas que harán de HIVE y su ecosistema un acceso para todos a la economía global, de ese cambio ya estamos formando parte y tú también.
