Habeas data is a legal term from Latin whose main meaning means "to have data present", it is a right of every person, in many cases constitutional, which enables any citizen to request the information that any company or entity has about him or her and request its deletion or update when it is old or contains errors or falsehoods.

Certainly, today having a formal job or a bank account implies simply handing over all the personal information we have. We are left with that minimal resource of Habeas Data so that from time to time we can check that what they have about us is at least correct and up-to-date, we cannot expect much more than that.

How much more do they need?

A few days ago my wife had to scan her face so that the banking application where she receives her retirement would allow her full use of all its functionality. It is not enough for them to know where their income comes from, their age, their address, their email, their signature, their fingerprint, their telephone number, and surely many other things that they would not dare to confess, they also needed to store somewhere. aside from his physical appearance.

Technology in your favor

All or at least most of this data can be obtained from our phones, technology has allowed this "convenience", to call it in some way, in the past, there was no other way than to go to the offices to meet those requirements, the miserable consolation would be not having to spend time on travel, the value of fuel or public transport ticket.

The original postulates of the bitcoin project promised something else and many of us are happy about it, over time we have understood that it will be practically impossible to achieve the argued privacy. Some restrictions and security schemes are understandable of course, but too many scammers and thieves are inspecting networks, software, and blockchains looking for weaknesses or just some fool to cheat.

It should also be noted that the still very partial acceptance of peer-to-peer exchange definitively threatens the need to exchange from or to fiat money to satisfy some of our needs and obligations, they have us well seized there.

And if that was not enough

A few days ago we learned that a cryptocurrency exchange house requests the scanning of the face of its users and a certain minimum deposit of USDC to give them a percentage in the same cryptocurrency. Many of us consider it a scandal, almost as if it were extortion or a bribe. The justification proposed by the company indicates that, by not requesting other types of personal data, they prevent fraud, that is, they ensure that no one obtains the benefit more than once.

That of course is what is said now, we cannot be sure if the protection of our image is part of some undisclosed regulation or if they are testing that mechanism to implement something else in the future.

Unfortunately, this comes from the ecosystem that was supposedly designed to defend the right to privacy.

One more nail in the cross of the original postulates of the bitcoin project where the non-need for a trusted third party was proclaimed.

Habeas data es un término jurídico proveniente del latín cuya principal acepción significa “tener datos presentes”, es un derecho de toda persona, en muchos casos constitucional, que posibilita a cualquier ciudadano solicitar la información que cualquier empresa o entidad posea sobre su persona y pedir su borrado o actualización cuando la misma sea antigua o contenga errores o falsedades.

Ciertamente en la actualidad tener un empleo formal o una cuenta bancaria implica entregar lisa y llanamente toda la información personal que poseemos. Nos queda ese mínimo recurso del Habeas Data para cada tanto poder chequear que lo que tienen de nosotros al menos sea correcto y actualizado, mucho más que eso no podemos pretender.

Cuanto más necesitan?

Pocos días atrás mi esposa tuvo que realizar el escaneo de su cara para que la aplicación bancaria donde recibe su jubilación le permitiera un uso completo de toda la funcionalidad que la misma posee. No les alcanza con saber de donde provienen sus ingresos, su edad, su domicilio, su correo electrónico, su firma, su huella digital, su número de teléfono y seguramente muchas otras cosas más que no se atreverían a confesar, también necesitaban almacenar en algún lado su aspecto físico.

La tecnología a su favor

Todos o al menos la mayoría de estos datos pueden ser obtenidos desde nuestros teléfonos, la tecnología ha permitido esta “comodidad”, por llamarlo de alguna manera, en el pasado no había otra forma que concurrir a las oficinas para cumplir con esos requisitos, el mísero consuelo sería no tener que gastar tiempo en viaje, el valor del combustible o el ticket del transporte público.

Los postulados originales del proyecto bitcoin prometían otra cosa y muchos nos alegramos por ello, con el tiempo hemos comprendido que será prácticamente imposible lograr la privacidad argumentada. Algunas restricciones y esquemas de seguridad son comprensible por supuesto, demasiados estafadores y ladrones andan inspeccionando redes, software y cadenas de bloques buscando debilidades o simplemente algún tonto para engañar.

También hay que destacar que la aceptación todavía muy parcial del intercambio entre pares atenta de forma definitiva contra la necesidad de intercambiar desde o hacia dinero fiat para satisfacer algunas de nuestras necesidades y obligaciones, allí nos tienen bien agarrados.

Por si fuera poco

Hace pocos días nos enteramos que una casa de cambio de criptomonedas solicita el escaneo del rostro de sus usuarios y un depósito mínimo determinado de USDC para regalarles un porcentaje en la misma criptomoneda. Muchos lo consideramos un escándalo, casi como si fuera una extorsión o un soborno. La justificación que plantea la empresa indica que, al no pedir otro tipo de datos personales, previenen el fraude, es decir se aseguran que nadie obtenga el beneficio más de una vez.

Eso por supuesto es lo que se dice ahora, no podemos estar seguros si el resguardo de nuestra imagen forma parte de alguna normativa no revelada o si están probando ese mecanismo para implementar otra cosa en el futuro.

Lamentablemente esto proviene del ecosistema que supuestamente fue pensado para defender el derecho a la privacidad.

Un clavo más en la cruz de los postulados originales del proyecto bitcoin donde se proclamaba la no necesidad de un tercero de confianza.
