Summary:
Within the system of the United Nations Organization, the UN can be found the Human Rights Council, the governing body in matters of, promotion, compliance and protection of Human Rights worldwide, but since its creation it lacks coercive power in in the event that it is determined that some government has violated the sacred principles of the human being, many problems arise from there, which means that said council finds itself in a situation of institutional vulnerability, which makes it more difficult every day that it can fulfill its functions.

Resumen:
Dentro del sistema de la Organización de las Naciones Unidas, ONU se puede encontrar el Consejo de Derechos Humanos, órgano rector en materia de, promoción, cumplimiento y protección de los Derechos Humanos a nivel mundial, pero desde su creación este carece de poder coercitivo en el caso de que en su seno se determine que algún gobierno ha violentado los principios sagrados del ser humano, de allí surgen muchos problemas lo cual conlleva que dicho concejo se encuentre en una situación de vulnerabilidad institucional, lo cual hace que cada día sea más difícil que pueda cumplir sus funciones.

Introduction
The organization of the United Nations UN, is the fundamental pillar of the international system for the protection of human rights, since its foundation when it replaced the former League of Nations, it seeks global governance through an advanced institutional system that privileges multilateralism and inclusion, but with the passage of time and the evolution of society, some flaws are beginning to become evident that put stability and compliance with many norms, including Human Rights, in suspense.

In the present investigation, it was decided to place the magnifying glass on the so-called Human Rights Council, which is the governing body in this matter, is made up of member states of the Organization elected by the General Assembly, and whose main objective is to ensure compliance to the full of everything related to Human Rights, but specifically they are in charge of ensuring compliance with these Rights within all member States without distinction. To achieve this goal there are different tools, such as the universal periodic review, the drafting of specialized reports, the issuance of recommendations and the sending of experts to the field, among others.

Introducción
La organización de las Naciones Unidas ONU, son el pilar fundamental del sistema internacional de protección de los derechos humanos, desde su fundación cuando sustituyo a la otrora Sociedad de las Naciones esta busca la gobernanza mundial por medio de un sistema institucional avanzado que privilegia el multilateralismo y la inclusión, pero con el pasar del tiempo y la evolución de la sociedad se están comenzando a evidenciar algunas fallas que colocan en vilo la estabilidad y el cumplimiento de muchas normas incluidas los Derechos Humanos.

En la presente investigación se decidió colocar la lupa sobre el denominado Consejo de Derechos Humanos, el cual es el órgano rector en esta materia, está constituido por Estados miembros de la Organización elegidos por la Asamblea General, y tienen como principal objetivo velar por el cumplimiento a cabalidad de todo lo relacionado con los Derechos Humanos, pero específicamente están a cargo de velar por el cumplimiento de estos Derechos dentro de todos los Estados miembro sin distinción alguna. Para lograr este cometido existen diferentes herramientas, como por ejemplo el examen periódico universal, la redacción de informes especializados, la emisión de recomendaciones y el envío de expertos al terreno entre otras.

Ahora bien todo pareciera estar en perfecto orden pero en la actualidad cuando se contrasta la teoría con la realidad surgen muchas interrogantes sobre si el papel de este consejo se está cumpliendo, ¿El Consejo de Derechos Humanos de la ONU es verdaderamente efectivo? Esta es una cuestión que se encuentra en pleno debate y existen una gran variedad de posiciones encontradas sobre este tema ya que incluso Estados miembros se encuentran en tela de juicio por parte de la Oficina de la Alta Comisionada en Derechos Humanos pero al parecer el poder del organismo para influir dentro de la corrección de estas presuntas violaciones pareciera ser nulo.

La idea fundamental de este estudio radica en la consecución de una explicación a la problemática planteada para de esta forma poder dar una imagen clara de la situación actual de dicho consejo y así evitar lo sucedido con nuestro referente histórico más cercano la ya mencionada Sociedad de las Naciones, cuya falta de efectividad la llevo al fracaso total. Teniendo en cuenta como antecedente lo expresado Irene Acevedo Albornoz y Jorge Riquelme Rivera en su artículo titulado “El Consejo de Derechos Humanos en el nuevo escenario mundial y los nuevos mecanismos de revisión” es importante revisar si efectivamente este organismo se encuentra en una posición que se ajuste o no a las necesidades de un mundo moderno, interconectado y en constate devenir.

The compilation of information on Human Rights and its relationship with the council has been carried out in a way that allows a clear analysis of the actions of the body and if its decisions lead to actions that allow responses to the problems raised.

El Consejo de Derechos Humanos desde una perspectiva Cualitativa
Teniendo en cuenta el carácter descriptivo de la presente investigación es importante resaltar que lo métodos que se utilizaron para llevar a cabo provinieron de información y material recolectado por los diferentes medios de comunicación, así como de los informes emanados de la ONU y el Consejo de Derechos Humanos. Se aplicó la observación detallada y la comparación para así determinar cómo es el accionar de las decisiones emanadas de dicho sub organismo internacional.

Es importante resaltar que en la actualidad el internet, se convierte en un instrumento de gran poder que nos permite obtener información en tiempo real y al mismo tiempo permite corroborar su veracidad, esto es un factor que facilita la posibilidad de llevar a cabo u proceso investigativo de forma rápida y confiable.

La recopilación de información en materia de Derechos Humanos y su relación con el concejo se ha realizado de forma que permita analizar de forma clara el accionar del órgano y si sus decisiones conllevan a acciones que permitan dar respuestas a las problemáticas planteadas.

Results
Just by looking carefully at the founding charter of the UN, it can be determined that within its operation there is a determining factor, which is the Security Council and its five members with veto power, they have the sole power to make decisions and enforce them coercively if necessary and that can apply at any point in the global geographic space, this situation makes it imperative that the focus of the investigation be immediately transferred to the Human Rights Council, which in essence can be determined to be a body of a conciliatory nature, which has as its main weapon the preparation of reports that in turn recommend governments to modify one or another action in order to correct the violations that may occur in terms of Human Rights.

But without a doubt that with the passing of time the Council has sought to improve its actions so that in this way greater pressure can be exerted when requesting a solution to the problems encountered before a government, for which improvements have been applied that even include civil society as indicated by Albornoz (2011)

Resultados
Con solo mirar detenidamente la carta fundacional de la ONU se puede determinar que dentro de su funcionamiento existe un factor determinante, el cual es el Consejo de Seguridad y sus cinco integrantes con poder de veto, en ellos recae la única potestad de tomar decisiones y hacerlas cumplir de forma coercitiva de ser necesario y eso puede aplicar en cualquier punto del espacio geográfico mundial, esta situación hace imperativo que la mirada de la investigación se traslade de inmediato al Concejo de Derechos Humanos el cual en esencia se puede determinar que es un órgano de carácter conciliador, el cual tiene como principal arma la elaboración de informes que a su vez recomiendan a los gobiernos modificar una u otra acción en aras de la corrección de las violaciones que se puedan presentar en materia de Derechos Humanos.

Pero sin duda alguna que con el pasar del tiempo el Consejo se ha buscado mejorar su accionar para que de esta manera se pueda ejercer mayor presión al momento de solicitar ante algún gobierno una solución a las problemáticas encontradas, para ello se han aplicado mejoras que incluyen incluso a la sociedad civil tal como lo indica Albornoz (2011)

Like this investigation, many of the reports and actions emanating from the Human Rights Commission are of a qualitative nature, since the information comes directly from interviews, observation processes and discussions, which, although it is more socially friendly, also lacks of weaknesses, since if the reality obtained is not fully verified then it could result in a half-truth, this situation, coupled with the lack of coercive capacity, greatly limits the actions of the council.

La efectiva participación de la sociedad civil en la elaboración de los informes, se reconoce como un gran logro, pues permitirá formalizar la visión de una importante parte de la sociedad en un escenario global al que se han agregado con fuerza nuevos actores internacionales y transnacionales.

Esto permite que los informes elevados por el concejo tengan mayor peso político y social, además de que involucra a múltiples actores lo cual es muy beneficioso al momento de forzar la corrección de una situación desafortunada, además también es importante resaltar que la oficina de la Alta Comisionada para los Derechos Humanos cuenta con la potestad de enviar a cualquier Estado (contando con la aprobación de este) de delegados que le permitan evaluar sobre el terreno la situación, estos cuentan con plenas garantías y con un trato que se debe ajustar a las legislaciones internacionales permitiéndoles inmunidad y ciertas garantías que le ayudan a realizar su trabajo de forma independiente y segura.

Al igual que esta investigación muchos de los informes y acciones que se emanan de la Comisión de Derechos Humanos tienen carácter cualitativo, ya que la información proviene directamente de entrevistas, procesos de observación y discusiones, lo cual si bien es socialmente más amigable también carece de debilidades, ya que si la realidad obtenida no está totalmente verificada entonces esta pudiera resultar en una verdad a medias, esta situación aunada a la falta de capacidad coercitiva limita en gran medida el accionar del consejo.

Some considerations
It can be considered that the Human Rights Council does not fully comply with the task carried out by the UN, since it has weaknesses that make it vulnerable in the eyes of some world governments, which simply ignore its mandate and frame it as a body that violates national sovereignty and seeks the selective destabilization of governments that are not in tune with its interests, in addition to the inability to assert its voice through the legitimate use of coercion plays against it, reducing it to the point of being just an organ in practice advisory consultation.

In addition, if we add to this situation that most of its research channels are based from a qualitative point of view, then it makes the investigative work much more complex and difficult to verify, since it must be remembered that the individual as such does not it is objective in its entirety and its statements have very large personal burdens that are due to many external factors that can greatly interfere with the achievement of a reality.

Algunas Consideraciones
Se puede considerar que Consejo de Derechos Humanos no cumple en su totalidad con el cargo realizado por parte de la ONU ya que presenta debilidades que lo hacen vulnerable ante la mirada de algunos gobiernos del mundo, que simplemente ignoran su mandato y lo enmarcan como un órgano que violenta la soberanía nacional y busca la desestabilización selectiva de gobiernos no afines con sus intereses, además la incapacidad de hacer valer su voz por medio del uso legítimo de la coerción le juega en contra, reduciéndolo al punto de en la práctica ser solo un órgano de consulta con carácter recomendatorio.

Además, si a esta situación le sumamos que la mayoría de sus canales de investigación se basan desde el punto de vista cualitativo entonces hace que el trabajo investigativo sea mucho más complejo y difícil de verificar, ya que se debe recordar que el individuo como tal no es objetivo en su totalidad y sus declaraciones tienen cargas personales muy grandes que obedecen a muchos factores externos que pueden interferir en gran medida dentro de la consecución de una realidad.

Conclusions
Within the UN Human Rights Council, a substantial change is required that allows it to adapt to the current circumstances, a body is needed that is capable of responding to the continuous violations of rights that are experienced in various parts of the world, it is necessary a Council that not only has a voice but also the ability to interfere and solve all those situations that put human integrity at risk on behalf of the world.

It is clear that the Human Rights Council is not effective and that it requires more attention from the international community, it is limited by its limited capacity for action and by its form of investigation, the scope of an investigation only of the qualitative type is limited to observation and little interaction with statistical data that in this case would be of great help to be able to explain and respond to the problems raised, which puts the integrity of Human Rights at risk, it is important in this sense that it be give priority to mixed-type investigations where scientific reports can be prepared that not only depend on social or individual sources but are reinforced by real statistics and precise calculations that attest to the reality studied, in order to be able to achieve work of greater significance and importance.

This research sought to link the qualitative view of Human Rights with the actions of one of the main organizations for their protection and how the relationship between the two leaves some gaps that only the political will of the governments of the world can correct, but we are aware that on the international board the individual interests of the great powers take precedence over the collective and, after all, they are the first ones who set the rules of the game.

Conclusiones

Dentro del Concejo de Derechos Humanos de la ONU se requiere un cambio sustancial que le permita adaptarse a las actuales circunstancias, se necesita un órgano que sea capaz de dar respuesta a las continuas violaciones de derechos que se viven en diversas partes del mundo, es necesario un Consejo que no solo tenga voz sino también la capacidad de interferir y solucionar en nombre del mundo todas aquellas situaciones que pongan en riesgo la integridad humana.

Está claro que el Concejo de Derechos Humanos no es efectivo y que requiere de mayor atención por parte de la comunidad internacional, se encuentra limitado por su poca capacidad de acción y por su forma de investigación, el alcance de una investigación solo del tipo cualitativa se limita a la observación y a la poca interacción con datos estadísticos que en este caso serían de gran ayuda para poder explicar y dar respuesta a las problemáticas planteadas, lo que pone en riesgo la integridad de los Derechos Humanos, es importante en este sentido que se le dé prioridad a las investigaciones de tipo mixta donde se puedan elaborar informes de carácter científico que no solo dependan de fuentes sociales o individuales sino que se vean reforzadas por estadísticas reales y cálculos precisos que den fe la realidad estudiada, para de esta forma poder lograr trabajos de mayor trascendencia e importancia.

En esta investigación se buscó enlazar la mirada cualitativa de los Derechos Humanos con el accionar de uno de los principales organismos de protección de los mismos y como la relación entre ambos deja algunos vacíos que solo la voluntad política de los gobiernos del mundo puede corregir, pero se está consiente que en el tablero internacional los interés individuales de las grandes potencias priman sobre los colectivos y a fin de cuenta son los primeros los que colocan las reglas del juego.
